Bill Collectors & Bankruptcy: What to Expect After Filing

Many people wonder what happens to bill collectors after bankruptcy. Here are the basics of what you should expect from bill collectors after you have filed for bankruptcy.

Automatic Stay

When you file for bankruptcy, the court is going to issue an automatic stay. When this is issued, your creditors will no longer be able to try to collect from you. At that point, they can no longer contact you through the mail or over the phone.

Court Contact

When you have successfully filed for bankruptcy, you are not going to have to do anything else to get the bill collectors to stop calling. The court is going to look at the list of creditors that you have and they are going to send a notification to these creditors telling them to cease and desist. At that point, you are not going to have to worry about a bill collector calling you any more.

Contacting Sooner

Typically, when the court contacts all of your creditors for you, they are going to mail them an official notice. This is going to take approximately 2 weeks in most cases. If you want to stop the bill collectors sooner than that, you should have your attorney call them personally.
